A major hurdle was cleared by the Boston Fire Company as it moves one step closer in its attempts to build a new fire hall. Mike Perley, the attorney representing resident Marilyn Will, whose property is adjacent to the company, said the two sides have settled a dispute regarding an easement on a portion of her property.

“I am pleased to report we have reached an agreement with the Boston Fire Company,” he said, adding that a notification is being sent to the town of Boston officials to let them know that Will is relinquishing her claim to the easement.

The Boston Fire Company is located at 6746 Mill St. near Boston State Road.

Perley said that the company’s representatives have expressed their hopes for a brand new facility. Brian Attea, the attorney representing the fire company, said the reason a new fire hall is being sought by the department is because the current location does not have the capacity to handle much of the modern equipment the department now uses.

Perley added that the current facility is too small. Although he said he did not want to go into many specifics of the pact, he said, “We’re satisfied we reach a good accommodation.

“It ran right where the building is,” Perley said, of the easement, adding that the facility had access from Boston State Road.

The dispute began several months ago after the fire department submitted plans to the Boston Town Planning Board for review.

Perley said that he is encouraged that the two sides were able to work cooperatively to reach an agreement and possibly pave the way for construction on a new fire hall.

According to Attea, the next step will be to get the plans before the planning board to begin the review process over again, with the ultimate goal of “construction of a new building.”

“The architectural renderings and drawings had already been submitted to the town, prior to the issue with the easement,” he said.

Attea noted that there is nothing in the agreement that will impact the size of the plans submitted to the town. “It should have no impact on the fire company’s original plan for construction,” he added.

The attorney said it will be up to the planning board now to review the plan and either make recommendations to make changes to it or recommend that the Boston Town Board approve it.

While Attea said he did not want to comment on a specific time frame, he said the Boston Fire Company would like to see the new facility in operation by the end of the year. “They’re very anxious to move forward with construction,” he concluded.
