SPRINGVILLE — Erie County Sheriff Timothy Howard announced that Dylan Schumaker has been charged with murder in the second degree, after beating his girlfriend’s child to death. An arraignment had not yet been scheduled, as of press time.
The victim, 1-year-old Austin Smith, would have turned 2 on Saturday, March 23.
Ashlee Smith, 19, left for work, at a nearby restaurant, at approximately 4 p.m., leaving Schumaker, her 16-year-old boyfriend, with Austin. Erie County sheriff’s deputies were called to the Cochran Avenue home at approximately 8:20.
Deputies attempted to resuscitate Austin, before the paramedics arrived. The child was transported to Bertrand Chaffee Hospital, where he was pronounced dead. The autopsy confirmed that Austin, who Howard said had bruises on his head, died of blunt force trauma.
The defendant was charged after the medical examiners completed their autopsy on the body, on the afternoon of March 20.
Howard said the teenager is believed to have beaten the boy with his hands.
Four-month-old Kristopher Trenary, who had also been in the suspect’s supervision, was placed in the temporary custody of Erie County officials.
The defendant and Smith had been living with Schumaker's family on Cochran Avenue for approximately two weeks. The subject told the sheriff’s deputies that he and Smith had been dating “on and off,” for approximately three years.
The suspect was expected to be arraigned on the murder charge in Springville Village Court, by the end of the week.
