MACHIAS — Shortly before midnight on Nov. 16, New York State Police Machias-based patrols were dispatched to Weaver Road in the town of Yorkshire for a possible domestic incident.
The first trooper to arrive on the scene noted a speeding vehicle leaving the complaint address and stopped it. The driver was Frank Bergholtz, 36, of Machias, He was determined to be intoxicated and arrested for driving while intoxicated.
Another responding trooper spoke with the caller. After the investigation was completed, Bergholtz was additionally charged with harassment second degree and criminal trespass second degree.
The DWI charge was elevated to a felony, due to a prior DWI within the last 10 years.
In addition, he was charged with felony aggravated unlicensed operation. Bergholtz refused a breath test.
He was arraigned in the town of Machias Court and remanded to the Cattaraugus County Jail in lieu of $5,000 cash or $10,000 bond.
